Why the Split?
Royal Decree 53/2023 took effect on 31 July 2023. The Ministry of Labour clarified that employers must apply the old formula (15 days per year for the first 3 years, 30 days per year thereafter) to service before that date, and the new formula (one month per year) to service from 1 August 2023 onward.
Savings System Advisory
The Social Protection Fund (Royal Decree 52/2023, Article 136) is scheduled to roll out a compulsory savings system that will replace EOSB no later than July 2026. From the effective date, employer contributions will be paid into a funded account instead of accruing as a lump sum at end of service.
About Oman EOSB
Royal Decree 53/2023 promulgated a new Labour Law for the Sultanate of Oman, effective 31 July 2023. Article 61 sets the post-service gratuity at no less than one full basic salary per year of service for periods governed by the new law, payable in proportion for fractions of a year.
For workers employed before 31 July 2023, the Ministry of Labour clarification (October 2024) instructs that the old formula under Royal Decree 35/2003 still applies to the period before the cut-off: 15 days of basic salary per year for the first 3 years of service, and 30 days of basic salary per year thereafter.
Dismissal with cause under Article 41 (or its predecessor in the old law, Article 40) results in no entitlement. Resignation, contract expiry, and termination by the employer outside summary-dismissal grounds all qualify for the full pro-rata gratuity.
