UAE Overtime Is Calculated on Basic Salary, Not Gross — and Some Workers Get Nothing at All

You earn AED 10,000 a month and worked 10 extra hours. You expect overtime on AED 10,000. Your employer pays it on AED 6,000 — and your employer is right.

Under Article 19 of Federal Decree-Law No. 33 of 2021, every statutory overtime premium in the UAE is computed on the basic wage, not the gross salary. If your package is split AED 6,000 basic + AED 4,000 allowances — a typical UAE structure — your legal overtime entitlement is 40% lower than what most workers expect. That single sentence explains the majority of overtime disputes in the country.

The night 50% rate does not apply to workers employed on a shift basis (Article 19). And these are legal minimums — a contract or company policy can pay more, never less.

The worked example: gross vs basic

10 normal overtime hours in a month with 22 working days, 8 hours a day:

The AED 284 gap is not the employer short-changing you — it is Article 19. The lever that actually moves your overtime pay is the basic/allowances split in your contract, negotiated at offer time. Two identical AED 10,000 packages can produce overtime rates AED 28 apart per hour.

The law does not fix a single divisor for converting monthly basic to an hourly rate. Many employers use basic ÷ 30 ÷ 8; payroll systems often use actual working days. On AED 6,000 basic, ÷30÷8 gives AED 25.00/hour and ÷22÷8 gives AED 34.09/hour — ask HR which method your company applies before disputing a payslip. The limits: 2 hours a day, 144 hours per 3 weeks

Article 19 caps ordinary overtime at 2 hours per day, exceeded only to prevent serious loss or accident — and total working hours may not exceed 144 hours in any 3 weeks (per the official u.ae guidance on working hours). Normal hours are 8 per day / 48 per week (Article 17), reduced by 2 hours per day during Ramadan. Hours worked beyond the reduced Ramadan schedule are overtime.

Who gets no statutory overtime at all

Cabinet Resolution No. 1 of 2022 (Article 15) excludes entire categories from the working-hours provisions — meaning no legal right to overtime pay:

  • Chairpersons and board members.
  • Supervisory/managerial roles vested with the powers of the employer — the test is the actual powers, not the job title.
  • Crews of naval vessels and seafarers with special service conditions.
  • Work that by technical nature must run continuously through successive shifts, within the averaging limits set by the Resolution.

A “Manager” title alone does not erase your overtime — the exclusion requires the role to actually carry employer powers (hiring, sanctioning, representing the employer). Public holidays: the substitute-day alternative

Article 28 gives the employer a choice most workers miss: instead of paying the premium, the employer may grant another day off for each holiday worked. Only when no substitute day is given does the cash formula apply — the wage for that day plus at least 50% of the basic wage. If your Eid shifts were “compensated” with a day off in the following weeks, that is lawful.

What to do if your overtime is unpaid

  1. Check your contract’s basic/allowances split and any overtime clause more generous than the law.
  2. Recompute your entitlement on the basic wage with the UAE Overtime Calculator.

  4. Raise it with HR in writing first; unresolved claims go to MOHRE (80060) and can proceed to the labour courts. Wage records under the WPS are the primary evidence.
